Terms of Service
1. Acceptance of Terms
By accessing or using the headlosscalculator.com website (the "Service") operated by Purpose Engineering Solutions, LLC ("Purpose," "we," "us," or "our"), you ("User," "you") agree to be bound by these Terms of Service (the "Terms"). If you do not agree, you must not use the Service.
These Terms apply to all visitors, signed-in users, and any other party accessing the Service. Manufacturers using the Manufacturer Portal are subject to the additional Manufacturer Agreement, which controls in case of any conflict with these Terms regarding manufacturer-specific terms.

2. The Service
The Service provides:
- Hydraulic engineering calculation tools (headloss calculator, pump selector, wetwell sizing, flow analysis, and related calculators).
- Manufacturer pump catalog with performance curves contributed by participating pump manufacturers.
- Educational content (the "/learn" article library and programmatic reference pages).
- Optional account features for saving scenarios and projects.
The Service is provided "as is" — see Section 8 (Disclaimer) and Section 9 (Limitation of Liability) below.
3. Account Registration
You may use parts of the Service anonymously. To save scenarios, request quotes from manufacturers, or access manufacturer-portal features, you must register for an account using a valid email address.
You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password.
- Promptly notify us at info@purposeas.com of any unauthorized use of your account.
You are responsible for all activities under your account. We may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Scrape, crawl, or systematically download content from the Service except as permitted by
robots.txt. - Submit false, misleading, or infringing content (including in scenario names, project descriptions, manufacturer listings, or quote requests).
- Send spam, malware, or harmful code through any communication feature of the Service.
- Use automated tools to abuse rate-limited endpoints (the public REST API at
/api/v1/*is rate-limited per the documented quota). - Interfere with or disrupt the Service's infrastructure.
5. Engineering Calculations — IMPORTANT
The Service's calculators provide computational assistance for licensed engineers performing their own design work. Results are NOT a substitute for the professional judgment of a licensed Professional Engineer (P.E.).
Specifically:
- The User is solely responsible for verifying inputs, validating outputs against engineering standards, and ensuring the design is appropriate for the specific project, jurisdiction, and end use.
- The Service does NOT certify, stamp, or take engineering responsibility for any design.
- Calculator outputs may contain bugs, rounding errors, or model limitations. Outputs should be cross-checked against authoritative references (Ten States Standards, AWWA M-series, Hydraulic Institute, etc.).
- Manufacturer pump curve data is supplied by manufacturers and presented as-is. Verify catalog data against the manufacturer's official datasheets before specifying.
By using the Service, you acknowledge that any reliance on its outputs is at your own professional risk.

6. Manufacturer Content
Pump performance curves, product specifications, and related data ("Manufacturer Content") are uploaded by participating pump manufacturers. Each manufacturer represents and warrants ownership of their content. We display Manufacturer Content as-is and do not independently verify accuracy.

7. Intellectual Property
- Our Content. All content created by us — calculator UI, /learn articles, programmatic reference pages, source code — is owned by Purpose Engineering Solutions, LLC and protected by copyright. You may use it for your own engineering work but may not redistribute or republish without permission.
- User Content. You retain ownership of scenarios, projects, and other content you submit. You grant us a non-exclusive, royalty-free license to host, display, and process your content as necessary to operate the Service.
- Manufacturer Content. Manufacturers retain ownership of curves and specs they upload. Their participation grants us a license to display this content on the Service.
8. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, NOR DO WE WARRANT THE ACCURACY OF ANY CALCULATION OUTPUT, MANUFACTURER CONTENT, OR EDUCATIONAL ARTICLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PURPOSE ENGINEERING SOLUTIONS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- DAMAGES ARISING FROM OR RELATED TO ENGINEERING DECISIONS MADE IN RELIANCE ON THE SERVICE;
- DAMAGES ARISING FROM MANUFACTURER CONTENT OR INTERACTIONS WITH MANUFACTURERS THROUGH THE SERVICE;
WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL FEES YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification
You agree to indemnify, defend, and hold harmless Purpose Engineering Solutions, LLC from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service;
- Your breach of these Terms;
- Engineering decisions you made in connection with the Service;
- User Content you submit.
11. Modifications to the Terms
We may update these Terms at any time. Material changes will be announced via email to the address on file for signed-in users and via a banner on the Service for at least 30 days. Continued use after the effective date of an update constitutes acceptance.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. You may terminate your account at any time by contacting info@purposeas.com.
Upon termination:
- Your right to use the Service ceases immediately.
- Saved scenarios and projects are retained for 90 days then deleted, unless you request earlier deletion.
- Sections 5 (Engineering Calculations), 7 (IP), 8 (Disclaimer), 9 (Limitation of Liability), 10 (Indemnification), 13 (Governing Law), and 14 (General) survive termination.

13. Governing Law
These Terms are governed by the laws of [STATE OF LLC FORMATION], without regard to conflict-of-law principles. Disputes shall be brought exclusively in the state and federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.

14. General
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No Waiver. Failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Entire Agreement. These Terms (together with the Privacy Policy and, for manufacturers, the Manufacturer Agreement) constitute the entire agreement between you and us regarding the Service.
- Notice. Notices to us must be sent to: info@purposeas.com (with copy to: [LEGAL ADDRESS]).
